Terms & Conditions:
a) The “owner” is “Graze & Gaze”
b) Customer or Gift Voucher holder refers to the person, firm or corporation booking an event or hiring equipment from Graze & Gaze
c) The Equipment means all the equipment and accessories supplied to the customer
d) Terms means the Terms and Conditions
e) Booking refers to the picnic event or equipment hire or gift voucher purchased between the customer and Graze & Gaze
f) 3rd party agent refers to company that Graze & Gaze has partnered with, providing a bundled product such as Climb, Graze & Gaze, Cruise, Graze & Gaze, Red Balloon and Royal Botanical Gardens
g) Inclement weather conditions refers to harsh or severe weather that may pose risks to safety, disrupt normal activities, or cause inconvenience. These conditions can vary depending on the location and season but typically
include:
1) Heavy Rain: Prolonged or intense rainfall that may lead to flooding or reduced visibility, wet and slippery ground.
2) High Winds: Gusty or sustained strong winds that can cause damage or make outdoor activities unsafe.
3) Hail: Falling ice pellets that may damage property
4) Thunderstorms: Storms accompanied by lightning, thunder, and often heavy rain or hail.
5) Extreme Temperatures: Either very high (heatwaves) or very low (freezing) temperatures. Such weather conditions often warrant caution, preparedness, or rescheduling of outdoor activities to ensure safety.
Mandatory Requirements:
a) Customer has read and accepts 3rd party agent’s terms of service, cancellation and rescheduling fees
b) Customer is responsible for not serving alcohol to minors
c) Customer enjoys the event in a communal public park exercising respect and responsibility of picnic locations and neighbours
d) Graze & Gaze Luxury Picnic Experience is an outdoor recreational event and the customer acknowledges, that Graze & Gaze do not have control of weather to enjoy your experience.
Changes to terms and Conditions:
All Terms and Conditions stated are subject to change without notice, provided that, in respect of any customer who has already purchased their experience or Gift Voucher, the Terms and Conditions prevailing at the time of purchase continue to apply.
Start Time:
Please arrive on time for your experience, our team can wait a maximum of 20 minutes from start of your picnic time. After this time, your picnic will be left unattended.
No show to your experience will result in no refund, regardless of the circumstances.
Graze Board & Dietary Requirements:
Vegetarian, vegan, halal, nut-free, gluten-free, and dairy-free options are available.
Please let Graze & Gaze know of any dietary requirements at least 48 hours before the picnic.
Guests:
1) Adults pricing is applicable for guests ages 13 and over
2) Child pricing is applicable for guests aged 3-12.
3) There is no charge for children under the age of 3.
4) Children only bookings are not permitted - a minimum of 2 adults must be included on every booking.
Deposit & Payments:
1) 50% deposit is required for all experiences & bookings, excluding Climb, Graze & Gaze and Cruise, Graze & Gaze which requires full payment when booking.
2) The remaining balance payment is due 7 days before your experience date
3) Due to Graze & Gaze’s alcohol license restrictions, no alcohol can be purchased from Graze & Gaze on the day of the event. We encourage customers to purchase choice of beverage no later than 24 hours of the event as per our extensive beverage list.
4) Apart from alcohol and catering, should on the day of the event, any extra’s are to purchased, please contact Graze & Gaze customer care to ensure availability at least 5 hours before the event. Please either make immediate payment with proof of payment or share your credit card details with customer care team for immediate payment as Graze & Gaze does not extend any credit terms.
Alcohol / Date of Birth:
1) When booking you're required to provide your date of birth; this is a requirement for our packaged liquor license.
2) NO ALCOHOL CAN BE SOLD OR SUPPLIED TO ANYONE UNDER 18. IT’S AGAINST THE LAW
Photographer Bookings:
1) When booking a photographer through Graze & Gaze, the photographer will be ready to shoot at the start of your experience, and they will leave after 20 minutes. If you are late to your experiences, additional charges by the photographer will apply if you would like the full 20 minute photo shoot.
Picnic Location:
1) Graze & Gaze picnics are set up in public parks and the locations are unreserved, therefore we cannot guarantee that your picnic will be in the exact location as advertised in our images. Public parks are generally busier on the weekends, especially when the weather is warm & dry.
2) Public parks are communal shared locations, noise level will need to be maintained at reasonable level without disturbing neighbours. Rubbish will also need to be collected and disposed without littering the harbour or the park. Graze & Gaze takes great pride in returning the event location in a tidy condition.
3) All bookings at the Royal Botanic Gardens must finish at least 1 hour before the park closes. You can view the parks closing times here: https://www.rbgsyd.nsw.gov.au/Visit/Plan-your-visit/Opening-Hours
Sharing of Personal Data:
1) We will not use or share your information with anyone except as described in the Privacy Policy

Release and Indemnity:
1) The Customer hereby releases the Owner from, and agrees to indemnify the Owner in respect of any third party claims, action, suits, demands, costs and expenses for damage or injury to person or property arising directly or indirectly out of the hire or use of the Equipment by the Customer or the Customer’s breach of any of these terms.
Force Majeure:
1) In the highly unlikely circumstances of an unexpected event occurring that prevents Graze & Gaze from providing the services agreed, Graze & Gaze will notify the Customer of the cancellation with as much notice as possible and will provide a full refund.
2) In the event that a public health order or legislation expressly prohibits from holding of the event and no alternative arrangements can reasonably be made to satisfy the requirements of the public health order or legislation, the Customer shall not be liable for the final payment, however, the booking fee will remain non-refundable.
Customer Requests Cancellation & Refunds:
1) Cancellations made more than 7 days before the picnic date will receive a 100% refund
2) Cancellations made less than 7 days and more than 3 days before the picnic date will receive a 50% refund less any 3rd party agent’s cancellation fees.
3) Cancellations less than 3 days before the picnic date will not receive a refund
Customer Requests Rescheduling:
1) You can make unlimited location, date or time changes up to 3 days before your picnic date. You can reschedule or we can issue a credit with 12 months validity from original date of booking, for future use. Reschedule booking and experience of picnic or product purchase will need to take place before or on the expiry date of the credit. Credit will be subject to 3rd party's rescheduling fees.
2) You are free to postpone the event on one single occasion, free of charge. Provided the customer provides more than 72 hours notice for rescheduling subject to the rescheduled date and location’s availability and subject to any 3rd party agent’s cancellation/rescheduling fees. More than one rescheduling regardless of circumstances, will incur $150 rescheduling fees.
3) Less than 72 hours and more than 48 hours notice to reschedule will be charged $150 rescheduling fees and will be subject to availability of dates, location and 3rd party's rescheduling fees
4) Rescheduling less than 48 hours is not permitted due to committed food and resources. Full payment and picnic will be forfeited.
Gift Vouchers and Credits:
1) The Australian Consumer Law (ACL) 1st November 2019, is only applicable on Gift voucher’s which were the original product purchased from Graze & Gaze.
2) Gift vouchers are strictly non-refundable but they are valid for 3 years from the date of purchase. The experience must take place before or on the expiry date of the gift voucher.
3) The value of gift voucher reflects the purchase price on the issue date. Any increase in the experience/product price or availability of the experiences, rescheduling fees, 3rd party agent fees, will be payable by the voucher holder at the time of booking/purchase of products.
4) On the occasion that experience paid by the gift voucher is cancelled or rescheduled by the customer, strictly no refund.
5) Gift vouchers are transferrable with proof of purchase. It must not be offered as prizes, offered for sale or resale or resold or used for any commercial purposes (including without limitation promotion of any supplier or any supplier’s products or services) without Graze and Gaze’s prior written consent.
6) Picnics paid by other means excluding by gift vouchers, will be issued a credit with subject to Customer Requests- Cancellation & Refunds and Customer Requests-Rescheduling's clauses and will be subject to any increase in the experience/product price or availability of the experiences, rescheduling fees, 3rd party agent fees, will be payable by the customer at the time of booking/purchase of products.
7) Credit issued will have 12 months life from the original date of booking.
8) The experience must take place before or on the expiry date of the credit issued
Experience paid by Gift Voucher Cancellation:
1) If notice of cancellation of the experience, is given more than 72 hours, gift voucher will be reinstated to the experience’s value of redemption less any 3rd party agent cancellation charges, to the gift voucher’s original date of purchase without changes to the original date of expiration of the gift voucher.
2) If the notice of cancellation date is provided less than 72 hours, $150 rescheduling fees will be charged to the gift voucher’s value, less 3rd party agent’s cancellation charges.
Experiences paid by Gift Voucher Rescheduling:
1) Rescheduling of experiences which are paid by gift vouchers, strictly requires more than 72 hours of notice, with subject of date, location and time availability and subject to any 3rd party agent charges to be deducted from the value of the gift voucher.
2) Less than 72 hours notice for rescheduling will incur $150 rescheduling and is subject to any 3rd party agent’s cancellation/rescheduling fees.
3) You are free to postpone the event on 1 single occasion, free of charge. Provided the customer provides more than 72 hours notice for rescheduling subject to the rescheduled date and location’s availability and subject to any 3rd party agent’s cancellation/rescheduling fees. More than 1 rescheduling regardless of circumstances, will incur $150 rescheduling fees.
Inclement Weather:
Graze & Gaze Luxury Picnic Experience is an outdoor recreational event and the customer acknowledges, that Graze & Gaze do not have control of weather to enjoy your experience.
If inclement weather is predicted 48 hours ahead of your Graze & Gaze experience, you have to three options to choose from:
1) You can reschedule your picnic to a new date of your choice, you can view all available times & dates here: https://www.grazeandgaze.com.au/experiences/luxury#book. No rescheduling fees of $150 will be charged.
2) Your picnic can be relocated to your hotel room or alternative sheltered venue located within 5km of the picnic location.
3) Contact Graze & Gaze customer care for an issue of credit which can be used up to 12 months from original date of booking. Note: strictly no refund will be issued
Graze & Gaze will contact customers via phone and/or email if inclement weather is predicted 72 hours leading to your event. It is the customer’s responsibility to monitor weather conditions and to make decision/take action as per above options.
Under no circumstances will Graze & Gaze proceed with the experience in the event of forecasted inclement weather. Graze & Gaze reserves the absolute discretion that an event will not proceed outdoors due to inclement weather that would impact customer and staff safety and equipment damage.
Wet Weather:
Graze & Gaze Luxury Picnic Experience is an outdoor recreational event and the customer acknowledges, that Graze & Gaze do not have control of weather to enjoy your experience.
1) Graze & Gaze will attempt to provide gazebos, subject to the location, based on the weather forecast or you are free to provide an alternative venue no further than 5km from the original experience location or your hotel room.
2) Under no circumstances will Graze & Gaze proceed with the experience in the event of forecasted inclement weather. Graze & Gaze reserves the absolute discretion that an event will not proceed outdoors due to inclement weather that would impact customer and staff safety and equipment damage.
Graze & Gaze will contact customers via phone and/or email if inclement weather is predicted 72 hours leading to your event. It is the customer’s responsibility to monitor weather conditions and to make decision/take action as per above options.
Graze and Gaze rescheduling of event due to inclement weather or local governing authorities restrictions:
Picnic will not proceed if Graze & Gaze decides to cancel a picnic for health, safety or security reasons or other reasonably necessary reasons, including but not limited to inclement weather, restrictions on access, occupancy and/or movement required by any Commonwealth, State, Territory or local government agency or body (including, any transport, road or maritime authority in New South Wales) (“Government Agency”), or any matters out of the reasonable control of Graze & Gaze.
1) No rescheduling fees of $150 will be charged
2) Credit of the event without the penalty of 3rd party agent’s cancellation fees will be issued as a refund.
3) Customer is encouraged to reschedule event at the earliest possible convenient date, time and location subject to availability and any 3rd party agent’s fees.
